It was revealed on Monday that New York Attorney General Letitia James had subpoenaed Donald Trump Jr. and Ivanka Trump as a part of her civil investigation into the Trump Organization.

The subpoenas were recently obtained by the New York Times but were filed on December 1 of 2021, according to Business Insider. Both the Trump children in the case have said that they will not comply with the order.

An attorney for the Trump children, Alan Futerfas, issued a motion with other lawyers to throw out the subpoenas. In this motion, Futerfas questioned James’ motive in the civil probe considering her office is also involved in a separate criminal investigation of the Trump Organization.

According to reporting by ABC News, Futerfas said “Attorney General James seeks to circumvent the entire grand jury process and nullify Moving Parties’ most fundamental constitutional and statutory rights by requesting that they provide non-immunized testimony to the OAG (Office of the Attorney General) – when the OAG/DANY is jointly conducting a grand jury investigation.”

The motion also noted that the attempt from James to subpoena the Trumps “are an obvious improper end-run around the rules,” according to reporting by NBC News.

Alina Habba, a lawyer for Donald Trump, also said in an emailed statement that James has “weaponized her office” through a “political witch hunt,” according to reporting by Reuters.

“Her actions are a threat to our democracy and I plan to hold her accountable to the fullest extent,” Habba said.

A spokesperson for the office of AG James reportedly said, “Despite numerous attempts to delay our investigation by the Trump Organization, we are confident that our questions will be answered and the truth will be uncovered because no one is above the law.”

In December, former President Donald Trump and the Trump Organization both separately sued James in federal court in an attempt to stop the civil probe. In their lawsuit, they accused James of trying to “harass, intimidate, and retaliate against a private citizen who she views as a political opponent.”

It was also reported that another of Trump’s children, Eric, was questioned by the AG’s office back in October of 2020.
