Colorado’s Supreme Court disqualified former President Donald Trump from appearing on the state’s ballots over his conduct surrounding Jan. 6.
The state’s highest court ruled 4-3 yesterday that Trump is ineligible to run in 2024 based on the 14th Amendment, which bars insurrectionists from holding public office. This marks the first time in history that the provision has been used to disqualify a presidential candidate.
The court overturned a previous ruling from a district court judge. In the original ruling, the judge found Trump incited an insurrection on Jan. 6 but could not be barred from the ballot because it was unclear whether the 14th Amendment was intended to cover the presidency.
Trump has until Jan. 4 to appeal the ruling.
