A federal judge has recently blocked the state of Montana from implementing its attempted ban of the TikTok phone app.
US District Judge Donald Malloy issued the preliminary injunction to block the ban, saying it “violates the Constitution in more ways than one.” Malloy added the ban “oversteps state power.”
The state legislature looked to ban the app citing concerns that personal data was being stolen and potentially used for spying. Users in Montana, as well as TikTok itself, had been seeking to prevent the ban from going into place.
Following the injunction, TikTok said it was pleased that the judge “rejected this unconstitutional law.”
A spokesperson for Montana Attorney General Austin Knudsen said they weren’t giving up just yet, noting that “the analysis could change as the case proceeds.”
