Florida Supreme Court allows abortion ban, tees up ballot referendum

The Florida Supreme Court has handed down a major win to pro-lifers, while also teeing up an abortion fight later this year.

Yesterday, the court upheld the state’s 15-week abortion ban passed in 2022 – paving the way for a stricter 6-week ban to take effect on May 1. Florida passed its heartbeat bill in 2023 with exceptions for rape, incest, and to save the life of the mother.

In a separate ruling, the court green-lit a ballot measure to enshrine abortion into the Florida constitution. If passed this November, abortions would be legal in Florida up until viability – usually around 24 weeks – and possibly even later than that to protect the health of the mother, effectively undoing the state’s previous bans.
