The Supreme Court recently handed down a major setback to President Joe Biden’s changes to Title IX.
Earlier this year, the Biden administration announced new rules, adding sexual orientation and gender identity to Title IX protections, prompting legal challenges from dozens of states. The rules were set to take effect on Aug. 1.
But in a 5-4 decision on Friday, the Supreme Court denied an emergency request from the White House to partially reinstate the rules currently blocked by lower courts in 26 states pending future litigation.
The case now returns to lower appeal courts but could return to the Supreme Court in the future.
