SCOTUS divided on expanding abortion exceptions in Idaho case

The Supreme Court seemed divided yesterday on whether Idaho’s near-total abortion ban violates a federal emergency medicine statute.

Liberal justices pressed Idaho’s attorney about the law’s single exception for cases where the mother’s life is at risk. Justice Sonia Sotomayor pointed out that other serious health problems should also qualify as emergencies.

The Biden administration is seeking to expand emergency abortions allowed under Idaho law. But Conservative Justice Samuel Alito said that the text of the federal statute used to challenge the ban could create problems.
