SCOTUS questions legal grounds to sue FDA over abortion pill

Supreme Court justices heard arguments concerning the abortion pill mifepristone yesterday, where a group of doctors argued that the FDA is knowingly endangering women.

Alliance Defending Freedom senior counsel Erin Hawley is representing the doctors. CBS News reports that the justices questioned whether the doctors have legal grounds to take the FDA to court.

Three conservatives in the court expressed skepticism. Justice Neil Gorsuch showed concern over “what could be a small lawsuit turning into a nationwide, legislative assembly on an FDA rule.”

Justice Brett Kavanaugh only spoke once to confirm that “under federal law, no doctors can be forced against their consciences to perform or assist in an abortion.”

The court is expected to deliver a final decision in July.
