The Texas Supreme Court is overruling a lower court’s decision allowing an emergency abortion for a Dallas woman whose baby has a likely fatal condition.
That ruling was put on hold after Texas Attorney General Ken Paxton asked the Supreme Court to intervene as state law only allows abortions to save the mother’s life or to prevent major bodily harm.
Yesterday, the court said the woman’s doctor failed to give evidence showing her case met this criteria. The court ruled, “These laws reflect the policy choice that the Legislature has made, and the courts must respect that choice.”
The mother is now seeking an abortion in another state.
