A legal battle over abortion is underway in the state of Texas.
A woman is now suing the state to end her pregnancy, citing a fatal birth defect and a history of health problems that put her at risk of complications should she give birth. It’s the first lawsuit of its kind following the overturning of Roe V. Wade and the first since Texas passed its heartbeat law in 2022.
The case is now being considered by the State Supreme Court. Texas law does not allow for abortions in cases of fatal birth defects. A judge previously ruled the law should make an exception in such cases, but that ruling was put on hold after being appealed by the Texas Attorney General.
The lawsuit is asking the court for a temporary restraining order and to protect the patient’s doctor from prosecution.
