FISM News recently reported on President Biden’s assertion that in the face of Justice Breyer’s retirement from the Supreme Court, he would be the first president to place a black female on the bench. However, there is more behind this supposed show of advocating diversity. The Supreme Court did almost have its first black female justice many years ago back in 2003, and it was in fact then senator Joe Biden who fought against her nomination.
