White House Press Secretary calls Roe reversal ‘unconstitutional’

White House Press Secretary Karine Jean-Pierre took aim at the Supreme Court on Wednesday, describing its decision to overturn Roe v. Wade and return abortion law to the individual states as “unconstitutional.” 

There has been an urgency from this president from day one, when the Supreme Court made this extreme decision to take away a constitutional right, it was an unconstitutional action by them,” she said during a press conference.

She went on to describe abortion as “a right that was around for almost 50 years, a right that women had to make a decision on their bodies and how they want to start their families.”

Following the SCOTUS reversal of Roe v. Wade, President Joe Biden similarly claimed the Court’s decision was not “driven by the constitution,” but was instead “an exercise in raw political power.” 

In the same press conference, Jean-Pierre said Americans had their rights “stolen” by the Supreme Court and described abortion as a “fundamental right.” She also praised voters in Kansas for rejecting a proposed amendment to the state’s constitution which would have allowed lawmakers to ban or restrict abortions.

Jean-Pierre also said Idaho’s abortion ban, which the Department of Justice is suing the state over, would not allow abortion in life-threatening cases, such as ectopic pregnancy. This is claim is demonstrably false.

The Idaho law says abortions will be permitted when a doctor determines “in his good-faith medical judgment and based on the facts known to the physician at the time, that the abortion was necessary to prevent the death of the pregnant woman.” Additionally, the procedure to terminate ectopic pregnancies, which are never viable and always threatening to the mother,  is not considered an abortion.
